Agreement Between You and Rise Art Award

The terms "Rise Art Award" or “RAA’ or the ‘Award’ or "us" or "we” or “our” refer to the owner of the Website and the organizer of the event, "Pixel Farm S.R.L." whose principal place of business is in Madrid, C/Pez, 15 4D, Spain.

The term "you" refers to the user, or the “Entrant”, or the “Participant” or the viewer of this Website.

Please read these terms and conditions carefully before you start to use the Website. By accessing and using this Website, you indicate that you accept (unconditionally and irrevocably) these terms and conditions (the ‘Agreement’). If you do not agree to these Terms and Conditions, please refrain from using our Website or entering any of its competitions and exit immediately. You promise to us you are over 18 years old of age to enter legally binding contracts through this Website and you know you will be responsible for material which you upload to this Website. You shall not upload any files that are unlawful to distribute through the Website.

The rules and terms listed by Rise Art Award need to be agreed by participants in order to enter the contest.

General Use of the Website

We have taken reasonable steps to ensure the information provided by us on this Website is accurate at the time you view it. We aim to ensure that availability of the Website will be uninterrupted and that transmissions will be error-free. However, we make no warranty whatsoever about the reliability, stability or virus free nature of such software. We reserve the right to withdraw or amend the service and content we provide on the Website without notice. Also, your access to the Website may occasionally be suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction. We will not be liable if for any reason the Website is unavailable at any time or period. Therefore, your access to and use of software and other materials on, or through, this Website is solely at your own risk.

We reserve the right to restrict certain areas of this Website to approved registered users. In the event that any area of the Website requires you to register with us prior to obtaining access, you agree to provide true, accurate, current and complete details, including but not limited to a member name and password as well as your name, address, telephone number and a valid email address ("Account Information"). You agree to update your Account Information as necessary to keep it accurate. Rise Artist Award will use your Account Information in accordance with our Privacy Policy. You agree to notify us immediately of any unauthorized use of your member name, password or account. Rise Artist Award will not be responsible for any losses arising out of the unauthorized use of your account and you agree to indemnify Rise Artist Award for any improper, unauthorized or illegal uses of your account.

Entry Fee

Although a user can create a personal account free of charge, in order to participate in the contest by submitting their artwork to Rise Art Award website, it is required a payment of a EUR €20 fee. It is compulsory to process your submission when entering a competition. The entry fees are established by the price list in effect at the time of registration. Entrant’s payment, fully completed registration form, artwork and supporting documents must be submitted online before January 20th 2016 23:59h GMT. Entry fees may change without notice. However, Entrants that have registered and paid their fee are guaranteed entry at their original fee. The registration fee allows you to enter one (1) competition and one (1) category of the contest at a time. Payment can be made through PayPal, Western Union or Bank Transfer.

Liabilities Discharged and Fees Owed for Incorrect Payment Information and Funds Deposited Into Incorrect Accounts

You agree that we have the right to charge you fees and costs associated with any incorrect bank account information you give us. You agree that if you give us incorrect, or someone else's, bank account or credit card information and we deposit or credit funds into it, then we will not be liable to pay you such amounts, all of our liabilities to you for such amounts will be discharged, and you will look solely to the recipient for payment.

Refund Policy

Once the fee is paid there will be no refund of it. The liability of Riseartaward.com to the Entrant, whether said liability stems from any breach of contract or duty, for any damages, costs, loss of goodwill or financial income suffered by the Entrant, will be limited to the Entrant’s paid fee. We will not provide a refund in case of incomplete submission.

Proprietary Rights

By entering this competition, you affirm that your entry is original and does not infringe upon the rights of any person or entity. You acknowledge that you own, are solely responsible or otherwise control all of the rights to the content or entries that you submit; that use of the content or entries you supply does not violate these Terms of Use and will not cause injury to any person or entity; and that you will indemnify us or our affiliates for all claims resulting from the materials you submit. Rise Art Award is not liable for any copyright or trademark infringement on the part of the Entrant. Participants are advised and required to obtain third party consents where required by law or by best ethical practices.

Ownership Of Work

Entrants own the Intellectual Property (I.P.) rights to the original work they submit to the Rise Art Award competition. We do not own original I.P. rights or works entered into the competitions, but has a royalty-free, perpetual right to use that work in connection with publicity and promotion of Rise Art Award programs. The Award’s sponsors or partners (Businesses and Organizations) are not allowed to use any works entered by participants, logos or any images that are Rise Art Award copyrights for publicity prior to receiving written consent from us.

Publicity

By entering your work in this competition, you grant consent and license to Rise Art Award and its sponsors and partners for the use of your name, artwork or design and representations of your artwork or design in any media, anywhere in the world, without compensation or credit, for the Award’s promotional and editorial reasons.

Cancellation Of The Competition

Rise Art Award relies on its partners when promoting the prize offered. Should any of our partners or sponsors fail for any reason to fulfill their commitment with us, Rise Art Award shall not be held responsible whatsoever. We shall make all effort to offer a similar prize with no time limit imposed. Should for any reason outside of our control the event be partly or wholly cancelled we shall offer the amount paid for the registration as a voucher to be used for future competitions held by us. This voucher shall be requested by the Entrant in written at contact@riseartaward.com within the time limit defined by us in case of such event only.

Proprietary Rights Restrictions

All material on the Website (hereafter known as Rise Art Award under the domain name “riseartaward.com”) including without limitation links and content to its social networks, all informational text, photographs, graphics, audio, video, messages, files, documents, images or other materials (collectively, the “Materials”), whether publicly posted or privately transmitted, as well as all derivative works, is owned by Rise Art Award or other parties that have licensed their Materials to us and is protected by copyright, trademark and other intellectual property laws. Rise Art Award disclaims any proprietary interest in trademarks, service marks, logos, slogans, domain names and trade names other than its own. Trademarks, logos, images and service marks displayed on the Website are the property of either Rise Art Award or other third parties.
